WHAT WOMEN VICTIMS OF DOMESTIC VIOLENCE NEED FROM THE CRIMINAL JUSTICE SYSTEM IN ROMANIA

ABSTRACT
Although the existing studies indicate a high rate of prevalence of the domestic violence phenomenon (e.g. 17,8% of women) [2] and according to different studies 15-25% of victims contacted the police [6], the number of the criminal files are really small, and the level of satisfaction with the intervention of the different institutions is law. We were interested in our study to analyse the intervention of the criminal justice system in domestic violence situations from the perspective of the women and the specialists. We interviewed 78 women having experienced domestic violence, 49 professionals (from criminal justice system and social and specialised services) and analysed 339 criminal files. Our research shows the complex relationship that exists between victims’ needs, especially their need for safety, and criminal justice outcomes. The ‘justice gap’ is huge. Many cases are lost at different levels of the criminal justice system. To reduce this “justice gap”, obvious changes are needed in terms of criminal justice policies and culture.
